Primary applicant is on EAD, how much min amount primary applicant has to show on W-2s?
question related to Dependent RFE:
Please submit evidence to prove legal immigration status in the USA from Jul 01, 2003 to Jul 29, 2004(I485 Receipt Date).
As dependent I came to US on H4 in 2001 and applied for H1 and approved in Jan 2002 (approved from Jan'2002 to Feb'2004).
Then don't know lawyer applied for my H4 extension along with my spouse's H1 extension. But they sent my passport for H4 stamping (stamped from Dec 2003 to Dec 2005). ie. I have 2 statuses at the same time and also here note that during december I was working. One more thing here my lawyer applied for my H1 renewal and got extension from Feb 2004 to Dec 2006.
Which extension papers(H1 or H4 attached with I94), should the dependent need to send to show legal immigrant status for the above query?really scared situation.
Please give your valuable suggestions.

Is this True --??
It seems USCIS has set a quota of X number of 485 applications till SEP 07.Once that quota reaches, dates will retrogress.
After that 485s will be processed by PD and not by RD.

Hello,
I am in my 10th year of H1B visa. (GC in process). Every other time I went to INDIA , I got my stamping in INDIA except in 2009 when I returned on Advanced Parole because of a lack of time. Now I need to go to INDIA again in July and I observed this condition for visa stamping at INDIAN consulates which is :
Have the same class of U.S. visa which is still valid or that has expired less than 12 months from the scheduled date of interview.
Wish to apply for the same visa class (e.g. had an H1 work visa, now applying again for an H1 work visa)
My question is whether my last entry to US on Advanced Parole will be interpreted as not having the same class of VISA. After I entered on AP , I did renew my H1 Visa and it is valid upto April'2011.
Thanks in advance for your help.

I am on EAD and I dont have any current employment, except a good faith future employment offer. I am already in bench more than 4 months and tired of it. I want to travel to India and come back after 2 months, using AP. What sort of questions being asked while entering USA and what documents I need to provide?
My friends are advising me not to leave the country. Please advise.
Thanks in advance

May 2010 promises to be a very good month for persons born in the Philippines who wish to immigrate to the U.S. through their relatives. Of course, when you are born in a country with some of the longest waiting times in the world for family-based immigration, "good" is a relative term. Want to immigrate through your parents who are U.S. citizens? The waiting times range from 15 to over 17 years depending on whether you are single or married. How about through your U.S. citizen brother or sister? The wait is a staggering 22 years! If you were born...

Over more than the last 30 years, Ive advised countless foreign businesses and investors seeking to establish operations in the United States. Many thrived, but some, regrettably, failed to survive. Often, the founders inattentiveness to the requirements of U.S. immigration law has been a primary cause of rough beginnings or failures to launch. This blog post will offer best immigration practices and identify traps to avoid when a foreign firm or individual plans to start a business in America. 1. Respect the Law Its Not a Game. The U.S. is no doubt the world leader when it comes to...

Lawyer Prashanthi Reddy seems to be very helpful.
She was introduced to me by IV through free conference call and we are planning to use her firm to represent my case.
Everyone's experience is different. So, please do your homework.

Did you move to a state, which comes under Nebraska Service Center? Hence your 485 application would have got moved to NSC.

Hi,
We filed our 485s during the July 2007 fiasco. We moved after an year, so we updated USCIS with our new address by filling AR11 online for all the petitions(485s, 140)
My 485 status is in pending state but by husband's petition has a status of "Notice Returned as Undeliverable". Now it is more than 6 months since that update. Do I have to follow up on it? Any input appreciated. Thanks much in advance.

Will there be any chance to revoke or cancel approved i140 if we file 2nd i140 with same employer . My employer is willing to give approved labor which is better (EB2 ,PD-2003) than my labor (EB3, PD-2003) . But right now i am on 6th year . I got a 3 years H1B extension recently. If my first i140 canceled (??) how about my H1B . is it still valid?

Seems there are so many issues for us to face on the journey to live the American Dream. I wonder how many members have been affected
Death of a petitioner, Step children of USC and H1B children aging out, E 2 children having no status upon reaching 21 years. And the lack of a retirement visa for our parents (usually elderly) to move to the USA, retrogression amongst other issues like delays errors
If you have been a victim of any of the above please show support by signing this petition http://expatsvoice.org/forum/petition.php maybe both sites can work together for the benefit of the majority

I'm going to guess that the same folks in the Tea Party screaming about the deficit will somehow find this breaking news to be irrelevant. Of course, they also think the sky's the limit when it comes to spending on immigration enforcement. So much for being consistent. I'm in France until Sunday and blogging from my iPad. I'm having a little trouble with links so please cut and paste this link in your web browser to read te CBO report - http://www.cbo.gov/doc.cfm?index=11991.
