My friend Margaret Stock has prepared an excellent report for the Immigration Policy Center entitled ESSENTIAL TO THE FIGHT: IMMIGRANTS IN THE MILITARY EIGHT YEARS AFTER 9/11. Margaret, an officer in the army and the undisputed leading national expert on immigration and the American armed forces, notes a number of key findings in her report: As of June 30, 2009, there were 114,601 foreign-born individuals serving in the armed forces, representing 7.91 percent of the 1.4 million military personnel on active duty. Roughly 80.97 percent of foreign-born service members were naturalized U.S. citizens, while 12.66 percent were not U.S. citizens....

under OPT you are still on F1 Visa...If you join another degree, you can still have F1, I believe you just need to inform the university on which your visa was issued about the university transfer. International affairs at your new univ. should help in this regard.

I am starting this thread for the people who are Greencard Holders and not married. Please share some thoughts for bringing their spouse here.
IV can help in this matter.
If all visa holders and citizens can bring their spouse instantly then why GC holder have to wait for many years after getting GC after many years.

Hi,
I'm on F1 visa and married to a GC holder. Should i apply for a dependent GC (I-130) on my husband's GC OR be on my F1 status untill the time he becomes citizen and then apply for the dependent GC?...What are the exact wait times for I-130 now?
If i dont apply for I-130 and go out of the country, will there be any issues while coming back to this country. What do you thing is the best way to go..
I'm ready to take some legal advice, so please let me know.

Senator Jeff Sessions of Alabama will become the ranking Republican on the Judiciary Committee under which the Immigration Subcommittee is included. Sessions has been one of the Senate's most vocal opponents of immigration reform. Sessions may only be in for the remainder of this Congress and then he is expected to pursue the ranking position on the Budget Committee. Iowa Republican Chuck Grassley has indicated his interest in pursuing the Judiciary job when the next Congress is sworn in.

Hi,
My I-140 was approved from Nebraska service center, but my attorney sent my I-485 case to Texas. I came across few people here on IV who have experienced the same.
Did USCIS provide any information regarding this? If so could you provide the link?

My I485 application was received at the Texas center on Nov 6th. No receipts yet and checks have not cashed, although the USCIS website says it is current for receipts. Anyone in my situation?

Hello gang! I have a quick question! Has anyone had issues with the prevailing wage being too low? The attorneys requested the prevailing wage from the SWA and it came back really high twice, so they then submitted a private wage survey that my company conducted with a reputable firm and it was rejected. The attorneys have said that they will now appeal the case directly to DOL. Has anyone had to go through this? If so, how long does appealing to DOL take? And, any info on success rate with the appeals to DOL?
Any info would be extremely appreciated! Thanks in advance guys!! :)

Hello All,
My I-140 was approved on 10/08/2008. But I am not sure if it is EB2 or EB3.
My labor was filed with MS + 2years but My I-140 Notice Type says:
Skilled Worker or Professinal, Sec 203(b) (3) (A) (i) or (ii).
I will appreciate any feedback.

I sent my I-140 on Apr 16, premium processing. How long does the premium processing take? I have to leave for India in a weeks time, and wanted to know if I would receive it in time.

If you have a valid I-94 i.e. not expired, you can apply for another I-539 to F1 - make sure to make the application stronger than last time.
If your I-94 is applied, you have no choice but to leave the country and get F1 visa in your home country and come back.
