My H1b got Approved and starts from OCT 1st and OPT Extension Expires in July 1st week.
I am travelling to India for 2 weeks in next month.
Do I need to go for Stamping? or my Current student status is valid :confused:

Hi,
I'm on H1 on 8th Year Extension,Got a nice offer from a company, which is not large company, but projects they have are very long term projects I applied for 485 long timeback, but did not applied for my spouse , who is on H4 , applied for H1 which will be validated from 1st Oct'06.Can I switch the company now and start using EAD and apply for my spouse when my PD becomes current , or wait with the current employer till I apply for 485.
Need SUggestion.
or
Can I ask new company to start new GC Process under Perm and apply for I-140 and once its get approved, Use My EB3 PD with the EB2 Perm Application.
Or
Can I use H1 Transfer and AC-21 option since my 8th year extension is till end of 2009.
Any Suggestions will be Very Helpful

With the new EB2 how much time does it take for Labor to get certified..I am applying in texas region in guess. I am from louisiana -mississippi area. Anyone there from this area ?.

Technically, You AOS application provides you status. So, unlike on H1b, you can be without a job for a long strech of time. The problem arrives, when there is an REF on your I-485 application to show proof of offer. If you can show proof of employment, you should be fine. But, There is a possiblity that USCIS might ask you for recent paystubs or W2s. So, I wouldnt be without a job for too long.
At least this is my understanding of it. Anyone differing from this opinion?

I and my wife are on h1. I want to come on her h4. She recently applied for h1 extension as her employer is nonprofit org and has some policies of his own, he files every year. She filled in may�09 and got receipt number, as the case is still pending who we can apply for h4 now. Is there any way around to apply for my h4 while the case is still pending?
You can file your H-4 based on the H-1b receipt of your spouse, this is not a problem. They will approve your H-4 for the same duration as your spouses H-1, you will get an approval of H-4 only after your spouses H-1 is approved.

Today I got an SLUD on my pending 485 after almost more than a year. Last one was from July, 2008 (address change). Don't understand what exactly is going on. For RFEs are there usually SLUDs before? or just an hard LUD with message change? Anyone in same boat? :confused:

Is there anyone whose I485 is pending for more than 90 days. My I-485 was sent on July 18th. I called USCIS twice and they are asking me to call them on Oct 17th (when 90 days is completed). They are saying that my appl.n should be in by then. Is there any one whose checks got cleared after 90 days. If not, what did you do about it.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200.
