Hi,
I am writing here for the first time.
My checks got encashed only for EAD/AP.
I filed concurrently I140/485 and PD is 2006.
Can some one tell if this is normal?

If your wife wants to transfer to a cap-subject employer, she will only be able to do so if the H-1 quota for the fiscal year has not been used up. If the H-1 cap has not been reached then transferring from a cap-exempt employer is no more difficult than transferring from a cap-subject employer. (though the new start date would have to be Oct. 1 or later)

If its few months of outside work.. should be fine... But you can't and should not just leave and work outside until you get GC.. May work, but chances are rare.. So risk is up to you to take and decide...

The attorney says he's regularly used the "Yes" response in such situations, and has successfully argued that the requirements are normal in past audits. Of course, he wouldn't comment on how much this contributes in triggering an audit. My goal is to avoid targeted audit altogether. His (and the company's) goal is to see the PERM through successfully, even in the face of an audit. Obviously, a slight difference in goals.
The requirements in fact are normal for this company, and in the field in general. I have no doubt that this can be successfully argued. The problem is with the face-value of the BS+7 requirement against the objective O*Net criteria, and the fact that the only way to make an argument is through a business necessity audit.

I am confused here, can some one shed light on this.
Say if we don't apply for AP-Advance Parole while filing with I-485 and EAD now as vaild stamped H1b is good till August 2008.In this situation while applying for AP next week would we have to pay new fee of I-485 $1010 as with new fee structure effective Aug 1st,2007 EAD & AP comes as a package along with it.
Please correct me if I have misintrepreted it.

Man you need to go help USCIS write a good program that helps them become efficient. I am still struggling with the idea that they lose thousands of Visa numbers every year just because of their inefficiency.

There is no AC21 for derivative applicants. She can join any employer at any time. AC21 comes into picture only for primary applicant. Derivatives get almost a virtual GC in terms of EAD.

Thanks guys. I just sat down and started trowing things on the canvas. It all came together by accedent. I still have some other little stuff to add to it.
I know it is kind of old school to use radial blurs and scan lines but the look so cool.

No. But the employer can file for 1 Year extension if there was a Labour or PERM was filed and it's pending. If I140 is approved and waiting for I485, employer can file for 3 year extension.

I filed my I-485 in July 2007. My I-140 approved. I want to file my EAD now. I have the following questions.
1) can I e-file ?
2) how much is the filing fee for me ?
3) what are the forms to fill and documents to send ?
