A piece of good news on immigration was largely overshadowed by the Arizona mess. Republican Senator Richard Lugar of Indiana and Democrat Dick Durbin sent a letter to DHS Secretary Napolitano urging her to stop the deportations of students who might be eligible for relief if the DREAM Act or comprehensive immigration reform should pass. DREAM would allow some who entered the US as children to obtain permanent residency if they attend college or join the military. No word yet on how Napolitano reacted.

My I140 (Bachelor degree, EB3, PD: Nov'04) was approved last month from my previous employer.
I completed my MBA in Jun'06 and joined another company; my job description has changed totally and I can't use previously approved labor for my new job. My new employer will initiate the process of labor, next week.
I checked with my previous employer and he informed me that he is ready to give me a support letter, if I want to go ahead and file I485 based on EB3 I140.
Questions:
Is it possible to file I485, even if we are not working with the employer?
Once I have filed I485 based on my EB3 I140, and if the application remains pending for next 6 months, is it still possible to port the PD (Nov'04) to the new EB2 based petition?

My company is converting my L1B to a L1A.I wanted to know if i can apply for a green card independently after my L1A has bee approved or does my company needs to process that application.

All Employment Based green card has to be petitioned by the employer. So in your case, you would need to ask you employer to start the process. Only exception are people with "extrodinary ability" (the David Beckham's and Michael J Fox's) and people who fall under "National Interest Waiver" category (EB1 only - people who hold a Ph.D.).

Hello all,
My AP had a date of birth error. I mailed the AP and supporting docs back to TSC (along with a check which has already been cashed) 0n Feb 20th and am traveling to India in July.
Any ideas as to how long it takes at TSC to process AP? The USCIS website points to a November 17th processing date for I-131 as of Feb 15th.
Any ideas as to how to speed up the process ?

Hi Gurus,
I have approved H1 for 3 years. I need to travel to India, but my AP is in Process. What I have heard is that it takes more than 2-3 months to get the AP approved. What are my options?
- Can I leave the country and get H1 stamp while AP is in process.
- Should I wait till AP gets approved?
- Is it OK to travel while while AP is in process?
Please advice?

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. In my opinion I think we should get the news guys into this and get the information out there about the irresponsibility with which they have mismanaged the whole process. Such kind of problems usually grab headlines when it happens with US citizens.
I think we need to be heard. Imagine, insurance companies violating makes news, social security makes news, airport security regulations and mismanagement makes news _ WHY CANT THIS? THIS IS SO CRUEL. HOW MANY HOURS, MONEY, EFFORT HAS GONE DOWN THE DRAIN? CAN WE NOT GET SOME NEWS CHANNEL TO COVER THIS? SOMEONE TO SPEAK TO A JOURNALIST ABOUT HOW AWFUL IT HAS BEEN????
THIS HAS ALL THE ELEMENTS OF PAIN, AGONY, AND DECEIT. Please comment. Only when we do this, will we get the EB numbers to get increased. Only then , the lawmakers will get up and smell the coffee. LEGAL IMMIGRANTS AND WHAT DO WE GET AFTER OBEYING THE LAW? MISMANAGEMENT THROWN AT OUR FACE.

I have an Andvance Parole valid till Feb'10 end. However right now am in India and wish to stay back even after the AP expiry. In this scenario is it good to apply for renewal AP from India or is it advisable to return back to US and then apply for AP?
Does any one provide how much time it takes for the renewal if I apply for AP from India. Do I need to give the India address for delivery? I have some one in US who can recieve the AP by mail and can send it by post to India. Is this an advisable?

I came to US on L1(worked for 1 year) and then switched to F1 till getting my H1B on May 2005 (which is 2 years old). How many years(3 or 4) do I have left on H1? I mean will the 1 year L1 count towards the total six years allocated for H1B?

However my employer took the advantage of my immigration status and reduced my salary drastically . I am planning to change my employer after I receive my H1B extension. Now I have following questions
1. If I accept new job with other employer and transfer my H1B to new employer, by what time (months, years..) my new employer has to file PERM to continue my GC process?
2. What if my current employer cancels my I-140 when I moved to new employer? Still can I use that I-140 to port my priority date to new employer?
I can plan my future employment based on your response. Thanks for your time.
